On Point with Peter van Aartrijk and Rick Morgan is an audio conversation with insurance industry leaders who champion change and challenge all of us to think.
Peter and Rick spoke with two legal experts who follow the insurance industry’s interest in social networking sites, such as LinkedIn and Twitter. They are attorneys Chris Belter and Colleen Murphy with the law firm Goldberg Segalla.
While not dispensing legal advice per se on this podcast, Colleen and Chris talk about the various ways agency employees can expose their firms to E&O claims or defamatory or anti-competitive lawsuits. Some agencies have jumped in, some are timid, and some are petrified.
The two most critical areas to be careful of are products and services….such as false warranties or misrepresentations. Be careful what your employees say about competitors and about how companies may not play claims, for example, the attorneys warn.
E&O attorneys help devise procedures for loss control. Colleen is a member of the Agents Council for Technology work group that created a social media policy for independent agencies.
